Can I make a claim against another skier or snowboarder for a collision?

Yes, North Carolnia law includes the duties commonly understood between skiers – for instance, uphill skiers must yield to skiers below and merging skiers yield to skiers on the run. Skiers and snowboarders are fully responsible for knowing their own skill level and staying within their abilities. They must:

  1. Control their speed and direction at all times.
  2. Follow all posted warnings.
  3. Ski only in designated areas.
  4. Avoid actions that could cause injury to others.

A violation of the statutory duties of skiing constitutes negligence

The ski area operator must comply with rules and regulations governing the maintenance and operation of ski lifts, has specific duties regarding signage and area inspections, including the duty to mark known hazards, and remains subject to a general negligence standard.

What is the statute of limitations for ski accidents in North Carolina?

Three years from the date of the incident, unless the injury caused death. In death cases, the claim must be filed within two years.
